Online Shopping

At Demarquette Ltd., we have taken great care in presenting the products on our website as accurately as possible. However, the images you see will depend on your monitor's display and colour capabilities. We are therefore unable to guarantee that the product images you see are an accurate representation of the actual merchandise.

By submitting an order to us through our website, you certify and confirm that you represent and warrant that the payment details provided on your order are valid and accurate and correct, and that when your order is accepted and processed by us, payment will be made in full. If the Billing details for your order are the same as your Delivery address details, by placing an order on the website you confirm that you are the recipient referred to in the Delivery address details. Otherwise, by placing an order, you confirm that you are the recipient referred to in the Billing details.

Acceptance of your Order
Shortly after you have placed an order with us, an email will be sent to you acknowledging the exact details of your order. This is not a confirmation of your order.

Order acceptance and the completion of the contract between you and Demarquette Ltd. will take place when your order is dispatched from our premises.

We may however have to reject your order based on a number of factors listed below:

- The product you ordered is out of stock
- Your payment has not been authorized
- an electronic error occurred not completing the full purchasing process

After your order has been placed and payment authorised, cancellations or modifications will not be accepted.
In no event can a change be made once your shipment has been accepted by the shipper.

Pricing Policy
All prices shown on the website are in £ Sterling and are inclusive of VAT (20%). Prices may change and offers may be withdrawn at any time.

Shipping originates from our production Lab in North Kensington. Shipping and packaging charges, which are payable by our customers, are extra, and vary by weight and destination. Due to high shipping charges and customs restrictions for perishable goods, we are unable to ship outside of the EU at this time.

Payment at time of order
All on-line purchases are subject to immediate payment using credit and or debit cards.

Please ensure that you submit your account number and the expiration date. All information should be provided in the appropriate field. Please verify the data you inputted for accuracy and completeness. Please see our Privacy Policy Statement (below) so that you may fully appreciate how this information is treated.

All online purchases are priced in Pound Sterling (£).
If your payment is made in a different currency, your final cost will depend upon the rate at which your bank card company exchanges your currency for the Pound Sterling and any additional fee charged for such exchange by your bank card company. The exchange rate may be fixed by your bank card company on a day other than the day on which you request product. Such charges are not levied or controlled by Demarquette Ltd..

Product Availability
Once an item is sold out it will be taken off the website at the earliest opportunity. All items are subject to availability.

Delivery of products

Product shipping
The products listed in our on-line boutique are suited for normal handling by our shippers or the Royal Mail in part or whole.

As our products are susceptible to high temperatures and humidity, deliveries during such periods or to countries with such climates are not advisable. As temperatures during deliveries are out of our control we cannot accept responsibility for any chocolate deliveries that have been heat- or humidity damaged.

The accuracy of the shipping information you provide is crucial in making sure that the products you request can be delivered in the normal course. This ensures that our customers can enjoy our products for the full extent of their shelf life. Demarquette Ltd. cannot be held responsible for returns occasioned by incomplete or incorrect delivery instructions; this includes the proper post code.

All reasonable efforts will be made to assure prompt delivery of your order. It is up to you to verify receipt with the delivery service. Failure to identify properly to the shipper problems upon delivery may result in your inability to pursue a claim. Most of our shippers require a signature upon delivery. Once the product is shipped and a Royal Mail Tracking Number issued, we cannot be responsible if it is lost or damaged from the environmental conditions in which it is left or that develop after its delivery.

Delivery time
Delivery times depend on the country of destination and the logistics companies handling your order.

Deliveries are made ONLY DURING business days or days when the logistics or parties representing the logistics or delivery companies operate.

ORDERS RECEIVED AFTER 10H GMT WILL BE PROCESSED AND SHIPPED THE NEXT BUSINESS DAY. Some Products will require up to 48 hours notice to prepare for shipping even where Next Day Delivery postage option is required.

Orders placed and received on Fridays, including Next Day Special Delivery service, may be shipped the following Monday as the Royal Mail have imposed higher shipping charges for week-end deliveries.

Demarquette will not be responsible for delays caused by events beyond its control, including strikes, natural disasters, or terrorism.

SHIPPING MAY TAKE LONGER DURING BUSY HOLIDAY SEASONS (CHRISTMAS, VALENTINE'S DAY, AND EASTER).

PLEASE NOTE THAT ALTHOUGH WE ENDEAVOUR TO DELIVER YOUR ORDER CLOSE TO YOUR 'IDEAL DATE FOR DELIVERY', WE CAN NEVER GUARANTEE DELIVERY FOR A SPECIFIC DATE OR TIME - THANK YOU.

To assure the quality of our chocolates we highly encourage Royal Mail Next Day Special Delivery for UK for orders under 2kg. All orders above 2kg will be send by Parcel Force when Next Day Special Delivery Service has been selected. We also offer the UK First and Second Class Signed For services which do not guarantee next day delivery and can take up to 5 working days. Vouchers & letters will be sent by 1st class mail service. Due to high shipping charges and customs restrictions for perishable goods, we are unable to ship outside of the EU at this time.

Please note that we are not responsible for paying import duties where applicable.

Please note that for deliveries within the EU of parcels under 2kg we use Airsure® or, where Airsure is not available (check Royal Mail website for list of countries), the closest tracked airmail service. Airsure is an upmarket mail, not a courier service. This means we cannot provide a guaranteed or certain delivery time, nor can we offer compensation for delays or missing Track & Trace information.

We aim to deliver goods to you within the time indicated by us in our acceptance but we cannot give an exact delivery date. Your 7 day cancellation rights under Distance Selling Regulations do not apply as the goods sold are perishable.

Upon dispatch of your goods we will send you a Royal Mail Tracking number. If you do not receive your goods within two working days for Special Delivery and 5 working days for First & Second Class recorded Mail after receiving the tracking number, it is your responsibility to contact Royal Mail to trace your package. Call 08459 272100.

Certain food items may be prohibited in a country to which they may be sent. It is your responsibility to check with the appropriate authorities to ensure the goods ordered are not prohibited. Also, some countries may levy an import tax or duty, which is beyond our control, and will have to be paid by the recipient on delivery of the parcel.

Shipping restrictions
Due to high shipping charges and customs restrictions for perishable goods, we are unable to ship outside of the EU at this time.

Feedback
Demarquette Ltd. prides itself on its high quality level of products and its service. If you have a comment or a wish to raise an issue, please contact us at once. We will work hard to understand the situation and if applicable will offer a means to remedy the situation. Please keep all documentation with you and contact us at once. Please inspect the parcel upon receipt to make sure it is consistent with the order and that there are no obvious flaws. Damage claims should be clearly recorded, dated and signed on the delivery invoice or delivery note.

All claims must be made within 24 hours of product delivery (that is the time the parcel has been signed for upon acceptance). Claims should be sent to our Customer Service Department, either by email to info@demarquette.com or by postal service offering proof of delivery of the parcel. The address for claims is as follows:

A full explanation of the problem, as well as the damages occasioned thereby must be detailed in your communication to us. After an analysis of the situation, Demarquette Ltd. at its own discretion will determine the appropriate remedy.
Demarquette Ltd. will not be liable for causes arisen by third parties including direct or indirect, incidental, accidental, loss of profit or revenue or any other loss arisen or related to a breach of this agreement or for claims against you by any third party.

Returns
Where Demarquette Ltd. accepts a return in the case of an obvious flaw or the nonconformity of the products delivered with an order, Demarquette Ltd. will allow the replacement of the product or the return of the amount paid by the consumer. By accepting this, you and any other party involved, agrees to waive any additional claims it may have, including for interest and other payments.

Privacy Policy
Our Privacy Policy Statement
In connection with your purchases, we will request from you only the information (including name and street and email addresses) necessary to fill and follow-up with your order. Information you give online goes to a secure server and is immediately encrypted.

Customer Data 
The information you provide to us during your use of our site will be used by us in order to supply you with goods and services under the Terms and Conditions of our website. 

Demarquette Ltd. does not store customer financial details (credit or debit card numbers) provided during the use of this site, nor do we share any such information with third parties.

We will never share your information with third parties outside of Demarquette Ltd, nor will we send you our own promotional e-mails without your consent. Any promotional email that you receive from us will also allow you to unsubscribe to further email promotions if you decide at a later stage that you no longer wish to receive emails with news and special offers from Demarquette.
 

Your rights
You are encouraged to tell us how we can keep you up-to-date with our product line, especially seasonal specials. We would be happy to communicate with you, and to have you communicate with us, by mail, email or telephone.

Warranty
Demarquette guarantees the quality and freshness of its fresh products for two weeks from the time they leave our premises in London, so long as they are handled and stored as recommended by the materials that accompany each shipment.

No Resale
When you order product from us, if you are a consumer, you agree that it is for personal use (by you or other individual(s)) and that it will not be resold by you.
